ORDER

By consent, the main writ petition itself is taken up for final disposal.

2. The petitioner has come up with the present writ petition for a mandamus, directing the first respondent to consider his representation dated 06.07.2016.

3. It is the case of the petitioner that the petitioner is working as Assistant Professor cum Liaison Officer in the Directorate of Distance Education Study Centre at Singanallur, Coimbatore District. Though he was appointed as lecturer cum Liaison Officer, he was allotted only liaison and administrative work. In the year 2008,on the basis of Syndicate Resolution No.41 dated 05.01.2008, the first respondent issued a circular on 23.01.2008 stating that designation of Professor/Reader/ Lecturer cum Liaison officers working in the various study centers of the Directorate of Distance Education were re-designated as Liaison officers by treating their service as non-teaching service.

Hence, some among them opted to continue as Liaison officers and gave undertaking that they want to cease their lean in the teaching profession and also gave their willingness to continue as Liaison officers and also gave acceptance letter for reduction of pay on par with the nonteaching staff in the institution. The first respondent accepted the same and passed orders to that effect. The petitioner made a similar request to the respondents along with them and also on 29.06.2015.

Since no order has been passed on such representations, he submitted another representation on 06.07.2016. But, the same was also not considered so far, left with no other alternative, the petitioner has come up with the present writ petition for the relief set out earlier.

4. I have heard the learned counsel appearing for the petitioner and the learned counsel who takes notice for the respondents.

5. Considering the facts and circumstances of the case and considering the submissions made on either side, this Court directs the first respondent to consider the representation of the petitioner dated 06.07.2016 seeking to re-designate him as Liaison Officer(non-teaching) and allow him to work as Liaison Officer in Singanallur Study Centre, within a period of four weeks from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed. Sd/- Assistant Registrar(CS-III) //True Copy// Sub Assistant Registrar mrp To
