( Criminal Jurisdiction ) Friday, the Fifteenth day of November Two Thousand Nineteen PRESENT The Hon`ble Mr Justice A.D.JAGADISH CHANDIRA CRIMINAL MISCELLANEOUS PETITION Nos.13898 of 2019 IN CRL.RC.NO.990/2019 M.NARAYANAN [ PETITIONER ] Vs P.GOVINDARAJ [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Crl.RC.No.990/2019 on the file of the High Court, the High Court will be pleased to [i] suspend the sentence imposed on the petitioner/accused to undergo simple imprisonment of 6 months with fine Rs.5000/- and in default pay the fine additional one month simple imprisonment order passed in C.C.No.39 of 2016 dated 15.11.2017 by the Judicial Magistrate, Fact Track Court, Dharmapuri which was confirmed in Crl.A.No.38 of 2017 dated 16.09.2019 by the Additional District and Sessions Judge, Dharmapuri, pending disposal of the above Crl.RC.No.990/2019.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of (No Appearance) Advocate for the petitioner the court made the following order:- This Court, earlier, by order dated 27.09.2019, directed the petitioner/accused to deposit 20% of the cheque amount, within a period of four weeks from the date of receipt of a copy of that order and the matter has been posted today i.e., (15.11.2019), for reporting compliance.

The learned counsel for the petitioner on the earlier hearing submitted that the counsel is yet to receive the proof of compliance of the earlier order of this Court, dated 27.09.2019. Today, there is no representation.

If the petitioner/accused has not been complied with the conditional order, the Trial Court shall take steps to commit the petitioner/accused in to the custody for undergoing the sentence.

The learned counsel for the petitioner is directed to take private notice on the respondent. Post the matter in the usual course.
