[Order of the Court was made by M.SUNDAR, J.,] When the captioned matter was taken up, it came to light that there is an allegation about one Mr.Vijay but he has not been made as a party to the captioned 'Habeas Corpus Petition' [hereinafter 'HCP' for the sake of brevity, convenience and clarity].

2. Mr.M.Vetrivel, learned counsel on record for petitioner sought leave of this Court to withdraw the captioned HCP but made a request to preserve all the rights and contentions of petitioner and / or anyone concerned for petitioner's daughter 'xxxxx' [we are masking the name of petitioner's daughter and we shall be referring to petitioner's daughter as 'absentee' for the sake of convenience and clarity] to come to this Court with same / similar prayer after arraying Mr.Vijay and / or any other person, who is deemed to be a necessary or appropriate party.

3. A scanned reproduction of the endorsement made by learned counsel for HCP petitioner in the case file is as follows: Page Nos.2/4

4. In the light of the narrative thus far, captioned HCP disposed of as closed / withdrawn albeit preserving all rights and contentions in the aforesaid manner.
