PRAYER: Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or direction in the nature of writ, to direct the first respondent to register the First Information Report and constitute a special investigation team (SIT) to probe into issue by considering the representation of the petitioner dated 12.07.2025, in accordance with law.

The Writ Petition (Criminal) has been filed seeking a direction to the first respondent to register a First Information Report and to constitute a Special Investigation Team (SIT) to probe into the issue by considering the petitioner's representation dated 12.07.2025. When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) submitted that originally the sixth respondent had given a complaint against the petitioner alleging that on the promise of securing a job, the petitioner received a sum of Rs.3 lakhs and cheated him. On the very same day, the petitioner had given a counter complaint alleging that the sixth respondent had kidnapped him using his 2/5
henchmen. The respondent Police conducted an enquiry in both complaints and found that there was a money dispute and that the allegation of kidnapping by henchmen was also false. Hence, both complaints were closed on 23.12.2024 itself.
The learned Government Advocate (Criminal Side) further submitted that in respect of the very same allegations, the petitioner has sent a representation dated 12.07.2025. Since the allegations in the representation are identical to those raised earlier, the respondent Police have not initiated further action. He further submitted that a closure report will be sent to the petitioner.
Recording the submissions made the learned Government Advocate (Criminal Side), this Writ Petition (Criminal) stands closed. The fourth respondent is directed to send the copy of the closure report to the petitioner within a period of two weeks from the date of receipt of a copy of this order. No costs 06.11.2025 ham 3/5
