(Made by P.N.PRAKASH, J.) The petitioner was granted suspension of sentence and bail by a Co-ordinate Bench in Crl.M.P.No.1919 of 2020 in Crl.A.No.98 of 2020 on 08.07.2020, on two conditions. However, in the same petition i.e., Crl.M.P.No.1919 of 2020, modification of the first condition imposed on 08.07.2020 was sought and in the said petition, the same Bench, by order dated 15.07.2020, modified the first condition as under :

"In paragraph 9(i) of the earlier order of this Court dated 08.07.2020 it has been mentioned as "the accused is directed to execute his own bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) before the learned Judicial Magistrate, Uthangarai, Krishnagiri District." In view of the prevailing pandemic situation paragraph 9(i) is hereby modified as "the accused is directed to execute his own bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) before the Superintendent of Prison, Central Prison, Vellore."

Seeking relaxation of the second condition viz., the petitioner should report before the Judicial Magistrate, Uthangarai, on the first Monday of every month until further orders, imposed on 08.07.2020, this petition has been filed.

2. Heard Mr.V.Krishnamoorthy, learned counsel for the petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor appearing for the respondent State.

3. On instructions, the learned Additional Public Prosecutor submitted that the petitioner has been complying with the second condition imposed on 08.07.2020, till date.

4. In view of the above, the second condition imposed on 08.07.2020, is modified to the effect that the petitioner shall report before the trial Court once in three months commencing from 01.12.2022 on the first working day of the month at 10.30 a.m, instead of reporting before the Judicial Magistrate, Uthangarai, on the first Monday of every month.

This petition is ordered with the above modification.
