ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus directing the respondent herein, to dispose of petitioner's representation dated 17.03.2025 seeking sub-division patta in patta no.260, with respect to petitioner's property comprised in Survey No.3/1, admeasuring an extent of 2166 square feet situated at No.108, Thozhupedu Village, Madurantakam Taluk, Chengalpattu district.

The case of the petitioner is that, petitioner's mother purchased the subject property comprised in New Survey No.3/1, situated at No.108, Thozhupedu Village, Madurantakam Taluk, Chengalpattu District from one Rathinammal W/o. Dass, vide Sale Deed dated 06.03.1986 registered as Doc.No.208 of 1986, SRO, Achirapakkam. Whileso, petitioner's mother settled the subject property in favour of petitioner and his brother vide Settlement Deed dated 26.04.2021, registered as Doc.No.2250 of 2021, SRO, Achirapakkam. In view thereof, petitioner submitted a representation to the respondents dated 17.03.2025, seeking separate Patta and the same 2/5
was kept pending. Aggrieved by the same, petitioner has come before this Court.

It is submitted by the learned Special Government Pleader for respondent that the representation dated 17.03.2025, which is stated to be pending would be considered and appropriate orders would be passed in accordance with law within the time frame fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the limited relief that is prayed, this court is inclined to dispose of the writ petition with following directions; i) The respondent authority shall consider the representation dated 17.03.2025, after issuing notice and affording a reasonable opportunity of hearing to the petitioner, his brother and any other interested parties including rival claimants, if any. ii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may influence the authority. The authority shall independently consider the facts and law set out in the representation and pass appropriate order in accordance with law 3/5
including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act and Rules.
iii) The petitioner's representation dated 17.03.2025 shall be disposed of within a period of twelve (12) weeks from the date of uploading of web copy without waiting for the receipt of certified copy. iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open.
v) There will be no order as to cost.
