The Proposed Respondent/Petitioner herein has filed a suit in O.S. No. 15 of 2016 before the District Court, Salem and in para 7 of the plaint in that suit, the birth of the Petitioner, viz., E. Geethesan, to the deceased E. Kumudha has been disputed. Learned Counsel appearing for the Petitioner submits that though the said contention has been raised, no relief for the same has been sought in that suit.

Having regard to the fact that the Fourth Respondent is declining to issue Legal Heirship Certificate of the said E. Kumudha on the ground that the aforesaid suit is pending, the Petitioner is necessary party to have an effectual adjudication of the matter in the Writ Petition. 3.

This Petition is ordered.
