Writ petition No.40626 of 2016 filed under Article 226 of the Constitution of India, for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the RE-DO/CONDONATION LIST dated nil published by the 2nd respondent and quash the same and consequently direct the 2nd respondent to permit the petitioner to continue with the fourth year course for the academic year 2016-2017 in the 2nd respondent college by considering his representation dated 04.11.2016.

Writ petition No.40627 of 2016 filed under Article 226 of the Constitution of India, for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the RE-DO/CONDONATION LIST dated nil published by the 2nd respondent and quash the same and consequently direct the 2nd respondent to permit the petitioner to continue with the fourth year course for the academic year 2016-2017 in the 2nd respondent college by considering his representation dated 04.11.2016.

to call for the records pertaining to the RE-DO/CONDONATION LIST dated nil published by the 2nd respondent and quash the same and consequently direct the 2nd respondent to permit the petitioner to continue with the fourth year course for the academic year 2016-2017 in the 2nd respondent college by considering his representation dated 04.11.2016.

2. Heard the learned counsel appearing for the petitioners, the learned standing counsel appearing for the first respondent and the learned Special Government Pleader appearing for the second respondent.

3. The learned Special Government Pleader appearing for the second respondent submitted that the petitioner in WP.No.40626 of 2016 is having only 22% of attendance and the petitioner in WP.No.40627 of 2016 is having only 36% of attendance and therefore, it cannot be condoned.

4. By way of an impugned communication, the petitioners were called upon to re-do the course, since they were not having sufficient percentage of attendance. Though the petitioners sought to justify their absence and seek to condone the shortage in attendance, in view of the fact that these petitioners were having only 22% and 36% of attendance respectively, which is far below the required attendance of 75%, this Court is not inclined to interfere with the impugned order.

5. Accordingly, the writ petitions fail and the same are dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
