These Miscellaneous Petitions have been filed to condone the delay of 775 days in setting aside the abatement caused due to the death of the sole appellant Mr.C.Ramamoorthy; to set aside the abatement caused due to the death of the appellant; to bring on record the proposed parties as appellant and respondents 3 to 6 as the legal representatives of the deceased appellant in the above Second Appeal.

2. It is submitted by the learned counsel for the petitioner (proposed appellant) that the proposed respondents 3 to 6 though the legal heirs of the deceased appellant, they did not evince any interest to conduct this Second Appeal and hence, the petitioner has sought to implead them as proposed respondents 3 to 6.

3. Being satisfied with the reasons stated in the affidavits filed in support of these miscellaneous petitions, the same are allowed.

4. Issue notice to the newly impleaded respondents 3 to 6 returnable by 19.02.2025. Private notice is also permitted.

5. List the matter on 19.02.2025.
