The Advocate Commissioner Report and the Objections by the parties perused.

2. One of the objection to the Advocate Commissioner is that the Commissioner has not collected the Statement of Accounts from 18.07.2018, the date on which Harbans Singh Anand died. Later, his wife Ranjit Kaur Anand, died on 09.03.2019. The complete statement since their death is essential for the adjudication. Yet another objection is regarding the error in description and allotment of the shares.

3. The learned Advocate Commissioner states that the warrant does not indicate the date from which the accounts to be collected from the bank. Therefore, the statement of Accounts furnished by the bank been collected and report submitted before this Court. He also further states that except one 1/5

account, which was operated by the first defendant Gurupratap Singh Anand and his father late Harbans Singh Anand, the rest of the accounts were on the death of the account holder were freezed and there is no transaction in those accounts.

4. In the above said circumstances and facts, after due consideration it appears the objections are trivial in nature. The report regarding the description and allotment of the shares filed by the Advocate Commissioner, the learned Advocate Commissioner states that, the typographical error regarding description of the shares will be taken note and necessary corrigendum to the report will be filed.

As far as the statement of Accounts, which sought to be collected from the date of demise of the parents, since all the banks accounts were freezed except one account after his parents demise, there is no need to entertain the said request. In alternate, as far as the one Account, which is jointly operated by the first defendant and his parents, it is suffice to direct 2/5

the first defendant to furnish the statement of Accounts for that particular account, which was jointly operated by the first defendant and his parents and continue to operate by the first defendant.

6. In the said circumstances, (i) the first defendant is directed to submit the statement of Accounts of the above said account from 18.07.2018. (ii) The Advocate Commissioner permitted to file corrigendum to his report is so required.

7. The Advocate Commissioner has filed a memo for additional remuneration. Taking into consideration the work done by him on behalf of this Court and being satisfied about executing the Commissioner warrant as directed by this Court, a sum of Rs.30,000/- is ordered to be paid to the Advocate Commissioner as additional remuneration. The same should be shared by all the parties equally .
