Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorari, calling for the records relating to the impugned Enquiry in Ref.No.Na.Ka.No.1071/B6/2023 dated 30.08.2023 purportedly issued under Section 77A of the Registration Act and quash the same.

ORDER
The writ petition has been filed against the enquiry notice. No writ against enquiry notice is entertainable unless it is issued by an incompetent authority having no jurisdiction or tainted with allegation of malafides. On merits the parties have to adjudicate the issues by presenting their defence statement and documents.
2.After arguing the matter, the learned counsel for the petitioner has chosen to withdraw the petition by stating that the petitioner will establish his case before the District Registrar who issued the impugned enquiry notice.
3.In view of the said submission, the writ petition stands dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
