O R D E R
The writ petition has been filed seeking for a mandamus directing the respondents to dispose of the petitioner's representation dated 30.08.2023, wherein and whereby she sought for issuance of patta in her favour and her brother's name A.Rajesh in respect of the property bearing plot numbers 5 and 6, Pasumpon Nagar, Pammal Village, Pallavaram Taluk, Chengalpattu District, South Chennai.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for respondents.
3. On 17.10.2023, when the matter was taken up for hearing, this matter was adjourned for filing counter at the request of learned Additional Government Pleader for respondents. However, the respondents have not filed any counter today. The Government Officials are not bothering about the innocent public. If a public files any representation, the Government Pg.Nos.2/6
Officials are not considering the same, instead they simply keeping the representation for years together for the reasons best known to them. There are also several allegations of corruption as against the Government officials. The Government officials are not at all considering the representations being made by the public.
4. In this regard, learned single Judge of this Court has passed an order dated 09.06.2023 in a batch of writ petitions in W.P.No.262 of 2018 [D.Tulasi Vs. The District Revenue Officer, Dharmapuri] etc., and subsequently, a circular dated 17.07.2023 bearing Circular No. R1/2005632/2022 has been issued by the Commissioner of Land Administration. However, the respondents have not either responded to the order of this Court made in W.P.No.262 of 2018 or to the circular dated 17.07.2023 bearing Circular No.R1/2005632/2022 issued by the Commissioner of Land Administration. This is how Government officials are functioning in a lethargic attitude which is highly condemnable.
5. Since the petitioner has filed the present writ petition seeking for simple mandamus to direct the respondents to consider his representation Pg.Nos.3/6
dated 30.08.2023 for issuance of patta in respect of the subject matter property, the respondents are directed to consider the petitioner's representation dated 30.08.2023 and pass appropriate orders on merits and in accordance with law, after affording due opportunity of hearing to the writ petitioner as well as rival claimants / interested parties, if any. Such exercise shall be completed by the respondents within a period of three months from the date of receipt of a copy of this order.
6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
