This Criminal Original Petition has been filed to quash the proceeding laid down inSTC No.264 of 2017, pending on the file of Fast Track Court (Magistrate Level), Judicial Magistrate-II, Ponnamalle.

2. Heard the learned counsel appearing for the petitioner and there is no representation on behalf of the respondent. Perused the materials available on record.

3. The learned counsel appearing for the petitioner submitted that the cheque amount has been already paid to the respondent and the matter has been settled. To substantiate his case he has produced receipt to that effect.

4. Since, there is no representation on the respondent side, the validity and authenticity of the receipt cannot be tested here, it is to be seen before the trial Court. In such view of the matter, this Criminal Original Petition is disposed of. The https://hcservices.ecourts.gov.in/hcservices/

petitioner is directed to appear before the learned trial Judge within the period of 15 days from today. On appearance, the learned trial Judge issue summon to the defacto complainant to inquire about the receipt and the payment of money. If the matter is settled, the trail Court shall compound offence, as per law. Consequently, connected Criminal Miscellaneous Petitions are closed.
