PRAYER : Writ Petition filed Under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus forbearing the Respondents from evicting the petitioners from our possession and from demolishing petitioners house comprised in Old Survey No.24/2 & 11 1/4

and New survey No.341/4 situated in Berigai Village, Hosur Taluk and Krishnagiri District, bearing Patta No.422 by considering petitioners representation dated 07.09.2022 except by due process of law and pass orders.

ORDER

By consent of both the parties, the writ petition is taken up for final disposal at the time of admission stage itself.

2. This Writ Petition has been filed seeking for issuance of Writ of Mandamus, directing the Respondents to dispose of the petitioners representation dated 07.09.2022.

3. The case of the petitioners are that the subject property is the ancestral property and the petitioners are in enjoyment and possession of the said property. Whileso, the concerned Village Administrative Officer is orally intimidating the petitioners to vacate him from the subject property as the said land belongs to Government for which the petitioner sent a representation to the respondents on 07.09.2022. However till date no action was taken. Hence, the present writ petition. 2/4

4. The learned Additional Government pleader would submit that they will not disturb the peaceful possession of the petitioners and further submitted that they will follow due process of law if they take any action against the petitioners.

5. Recording the submissions made by the learned Government Advocate this petition is closed. No costs. Consequently the connected miscellaneous petition is closed.
