Mr.S.Arumugam Govt Advocate For Respondent

ORDER

This writ petition has been filed to direct the respondents to issue patta for the property morefully described in the prayer to this writ petition in the light of

G.O.No.465 dated 27.11.2018.

2. A counter has been filed by the respondents, stating that the subject land has been classified as "Manthai Poramboke". However, in paragraph No.8 of the counter filed by the third respondent, it has been stated that suitable instructions have been issued to the subordinate officers in Letter Na.Ka.No.4292/2020/B1 dated 19.07.2024 by the first respondent to gather details of lands in the District as well as the alternate lands in coordination with the Animal Husbandry Department along with the NOC and send them in a consolidated manner to the Government. It has also been stated that based on the aforesaid instructions dated 19.07.2024 issued by the first respondent, the third respondent is also initiating action to gather the details by preparing a list of such lands.

3. Since, as on date, the land for which patta is sought for by the petitioner through this writ petition has been classified as "Manthai Poramboke", the question of granting patta in favour of the petitioner at this point of time does not arise.

4. The petitioner will have to wait for a final decision to be taken by the Government with regard to the reclassification of the lands, which includes the petitioner's land. Therefore, at this juncture, the relief sought for by the

petitioner in this writ petition cannot be granted.

5. For the foregoing reasons, liberty is granted to the petitioner to give a fresh representation in case the Government has taken a decision reclassifying the lands, which includes the petitioner's land, as a patta land in the near future. Once a final decision has been taken by the Government in support of the petitioner's case, the petitioner's representation as and when given for issuance of patta in his name shall be considered by the respondents on merits and in accordance with law as expeditiously as possible.

6. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
