Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to cancel the patta in Patta No.11371 issued in favour of the respondents 4 & 5 consequently restore the patta in Patta No.8778 in favour of the petitioner and other persons by considering the petitioner's representation dated 27.11.2023 within the specific period of time fixed by this Court. 1/5

O R D E R

The petitioner herein seeks a direction to the second respondent to cancel the patta issued in the name of the respondents 4 & 5 in respect of the property situated in S.No.765/1C1A1 with an extent of 5.5 cents and the lands in S.Nos.765/1C and 766/1C1.

2. It is the case of the petitioner that the above mentioned property was purchased by the petitioner and four others from the respondents 4 & 5 and others under a registered sale deed dated 14.11.2022. However, the patta was wrongly issued in the name of the respondents 4 & 5 who sold the subject property to the petitioner and others. Therefore, the petitioner submitted a representation before the respondent on 27.11.2023 seeking cancellation of the patta issued in the name of the respondents 4 & 5 and the same has not been considered. Hence, the petitioner is before this Court. 2/5

3. Mr.A.Selvendran, learned Special Government Pleader, who takes notice for the respondents 1 to 3 would submit that the representation of the petitioner will be considered, on its own merits, within a time frame fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to consider the representation of the petitioner dated 27.11.2023 and pass final order, on its own merits, within a period of 8 weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner, respondents 4 & 5 and other interested parties.

5. With the above direction, this Writ Petition is disposed of. No costs.
