Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorari, to call for the impugned final order vide C.P.No.1955/2019 dated 20.11.2020 of the third respondent and quash the same.

O R D E R

Aggrieved by the order passed by the third respondent directing the petitioner to pay deficit stamp duty as per Section 47-A of the Indian Stamp Act, the petitioner has come before this Court.

2. In the impugned order itself it is stated that as against the said order, appeal lies before the second respondent under Section 47-A(5) of the Indian Stamp Act. As seen from the typed set, in fact the petitioner also preferred an appeal before the second respondent against the impugned order and the appeal itself has been dismissed as time barred. The order passed by 2/5

the second respondent dismissing the appeal filed by the petitioner as time barred has not been challenged by the petitioner till date. Since the petitioner already availed an alternative remedy of appeal challenging the impugned order, this Court is not inclined to entertain this Writ Petition and accordingly, this Writ Petition is dismissed. However, it is open to the petitioner to challenge the order passed by the Inspector General of registration by filing further appeal under Section 47(A)(10) of the Indian Stamp Act in accordance with law and subject to law of limitation. No costs. Consequently, connected Miscellaneous Petitions are closed.
