The petitioners, who are arrayed as accused 4 and 5, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 7(5) of Tabbaco Prevention of Cigratte & others and Tabbaco Act, 2003 in Crime No.272 of 2016 on the file of the respondent police and hence, seek anticipatory bail.

2. When the petition is taken up for hearing, the learned Government Advocate (crl.side) submits that the offences levelled against the petitioners in this case is bailable in nature.

3. Recording the submission made by the learned Government Advocate (crl.side), this Criminal Original Petition seeking anticipatory bail is dismissed as not maintainable.
