This application has been filed to condone the delay of 91 days in filing the application to set aside the exparte decree passed in C.S.No.674 of 2007 on 01.12.2016.

2. The learned counsel appearing for the respondents has no objection to allow the application.

3. Such view of the matter, having satisfied with the reasons assigned in the affidavit and in order to give fair chance to the parties and to exercise their rights, this court is of the view that liberal approach should be adopted in condoning the delay.

4. Accordingly, this application is allowed. 24.09.2020 mst Note: The Registry is directed to number the set aside application filed by the applicant.
