ORDER

This petition has been filed to withdraw HMOP No. 76 of 2023 from the file of the Subordinate Court, Rasipuram and transfer it same to the Family Court, Salem.

2. The learned counsel for the petitioner submits that the respondent

filed HMOP No. 76 of 2023 on the file of Sub Court, Rasipuram, seeking for dissolution of marriage. Now, the petitioner living with her parents without any source of income and also she used to travel 60 kilometres to attend the Court proceedings. Hence, he prays to allow this petition.

3. Considering the above, the reason assigned by the petitioner is justifiable and also she is living with her minor child. Hence, the Subordinate Court, Rasipuram is directed to transfer HMOP No. 76 of 2023 to the Family Court, Salem. Further, the Family Court, Salem is directed to dispose the case as expeditiously as possible after giving notice to the respondent.

4.In result, this petition is allowed. No Cost. Consequentially, connected miscellaneous petition is closed.
