The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police, in pursuance of the Non-Bailable Warrant issued on 02.09.2014 by the learned IV Metropolitan Magistrate, Saidapet, Chennai, in connection with a case in C.C.No.5839 of 2013 for the alleged offences punishable under Sections 279 and 337 of IPC in Crime No.378 of 2012, on the file of the respondent police and hence, seeks anticipatory bail. 2.The learned counsel appearing for the petitioner submitted that the case was registered in the year 2012 and the petitioner was regularly appearing before the trial court and due to his illness, he could not appear before the trial court on 02.09.2014 and therefore the non-bailable warrant was issued against him. The learned counsel further submitted that the petitioner undertakes to appear before the trial court for all future dates without fail.
3.Heard the learned Government Advocate (Criminal side) appearing for the respondent.
4.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain
conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned IV Metropolitan Magistrate, Saidapet, Chennai, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall pay a sum of Rs.10,000/- (Rupees Ten Thousands only) towards donation to "CHILD CARE FOUNDATION" No.3, 4th Cross Street, Krishna Nagar, Pammal, Chennai - 600 075, Mobile No.72000 37832, , by way of Demand Draft or Cheque, within a period of two weeks from the date on which, the copy of the order is made ready and the petitioner shall appear before the learned IV Metropolitan Magistrate, Saidapet, Chennai, in connection with a case in C.C.No.
5839 of 2013 for all future hearings without fail. Except on those days his absence is condoned by filing a petition under Section 317 Cr.P.C. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. 2 6. 0 4.
