This petition has been filed seeking to condone the delay of 94 days in filing the appeal against the judgment and decree dated 25.11.2024 in O.S.No.50 of 2019 on the file of the II Additional District and Sessions Court, Tiruppur. 2.The suit had been filed seeking Specific Performance, but the suit had been decreed only for refund of advance amount paid. 3.Notice had been directed and the learned counsel had entered appearance on behalf of the respondents.
4.Though the learned counsel for the respondents stated that he would file counter, having noted the reasons stated, we would condone the delay but place a caveat that the learned counsel for the respondent would be heard at the time when the Appeal Suit is listed for admission. Accordingly, this petition stands allowed. The Registry is directed to number the appeal, if it is otherwise in order. 5.The Registry may print the name of Mr.K.Myilsamy as counsel for the 1st respondent in the cause list when the Appeal Suit is listed for admission.
