A No. 4256 of 2025 PRAYER Order payment out of a sum of Rs.67,37,500/- with accrued interest lying to the credit of E.P.No.99 of 2023 and issue the cheque in favour of the Official Assignee, High Court Madras representing the Estate of Arjunlal Sunderdas and record part satisfaction of the decree to the extent of Rs.67,37,500/-. Ananthakrushnan For Respondent(s): Mr.S.Arjun Suresh for R4&5 COMMON ORDER The issue relating to deduction of commission as well as audit charge for the deposit being made in a Nationalised Bank, pursuant to the orders of the Court to be charged by the Registrar General is pending adjudication before the Division Bench of this Court in Application No.4736 of 2024 in C.S.No.368 of 2019.
2. The Registrar General has been impleaded suo motu by the Division Bench in the said application and the matter was listed on 08.10.2025 for hearing. Unless the issues are decided by the Division Bench in that case, the
present application seeking direction to the 4 th and 5 th respondent to refund a sum of Rs.1,48,225/- deducting Government commission and audit fee cannot be considered. Thus, the present petitions stand allowed, by granting liberty to the official assignee to file appropriate petition, if required after disposal of the Application No.4736 of 2024 in CS.No.365 of 2019.
3. The 4 th and 5 th respondents are directed to issue a cheque in favour of the Official Assignee, High Court of Madras representing the Estate of Mr.S.Arjunlal Sunderdas (Deceased).
