The petitioners who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(aa) and 4(1-A) of TNP Act in Crime No.165 of 2022, seek anticipatory bail. 2.The case of the prosecution is that when the respondent on regular patrol, the petitioner were found to be in possession of 80 litres of ID arrack. Hence, the complaint.

3.The learned counsel for the petitioner would submit that this is the second application for anticipatory bail and the earlier application for anticipatory bail was dismissed by this Court on the ground that there are three previous cases pending against them. He would further submit that the petitioners are ready to abide by any stringent conditions imposed by this Court. Therefore, he prays for grant of anticipatory bail to the petitioners.

4.Per contra, the learned Additional Public Prosecutor would submit that the petitioners are habitual offenders against whom there are four previous cases similar in nature pending against them. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioners. 5.Taking into account the nature of offence and the previous antecedents of the petitioner and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.
