O R D E R

This Writ Petition has been filed to direct the first respondent herein to release the vehicle, namely, Eicher Lorry bearing Registration No.TN-10-V-0492 to the petitioner.

2. The learned counsel appearing for the petitioner submits that for the alleged illegal transportation of PDS rice which is meant for public distribution system, the petitioner vehicle and goods were seized by the second respondent and the same was handed over to the first respondent and thereby, the petitioner made a representation on 13.09.2023 to release the vehicle. Since no action was taken, the present writ petition has been filed.

3. When the matter is taken up for hearing, it is brought to the notice of this Court that during the pendency of this writ petition, adjudication was conducted and the District Consumer Forum passed an order on 21.09.2023 for confiscation of the petitioner's vehicle. Without challenging the order passed by the Competent Authority as per the

Essential Commodities Act, 1955, filing the present writ petition with the aforesaid direction is not sustainable one. As per the confiscation order, if the vehicle is not sold, there shall be a direction to the first respondent to instruct the Competent Authority under the Essential Commodities Act to bring the seized vehicle into auction in which the petitioner is entitled to participate.

4. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs.
