Respondents (R6-Suo Motu impleaded as per order, dated 06.06.2024 in W.P.No.29551 of 2023) Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 4th respondent to pay to the petitioner a sum of Rs.49,60,000/- (Rupees Forty Nine Lakhs and Sixty Thousand only) being the rent due from 01.07.2018 to 31.08.2023 and to continue to pay each month rent at the rate of Rs.80,000/- per month till the possession of the property is handed over to the petitioner. Today, Mr.R.Subramani, learned Counsel appeared on behalf of the petitioner.

2. Since, a query was raised by this Court on the earlier occasion with reference to his eligibility, placing reliance on the Bar Council of India Rules, dated 12.01.2015, he would submit that he is eligible inspite of his conviction in another case and he is not connected to the present case.

3. In view of the submission made, this Court permitted the learned Counsel to appear and argue the matter. After that, the learned Counsel appeared on behalf of the petitioner sought permission to withdraw the Writ Petition with a liberty to pursue his remedy as against the order passed by the Trial Court, dated 25.04.2023 in Crl.M.P.No.4649 of 2022 in C.C.No.13 of 2020.

4. Ms.T.Sugirtha, learned Counsel for the petitioner on record also appeared through online and consented for the same. 3/8

5. In view thereof, with such liberty kept open to the petitioner, this Writ Petition is dismissed as withdrawn. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. 09.06.2025 : yes/no grs To
