in S.A.No.828 of 2021 P.T.ASHA, J., Both the counsels have consented to the appointment of Mr.C.Durairaj, Advocate, as Advocate Commissioner, having office at AKT Complex, Kallakurichi (Mobile No: 9361511532) to inspect the property, which is the subject matter of the suit in O.S.No.514 of 2009 and note down its physical features, measure the same and fix the boundaries. To do so, the learned Advocate Commissioner shall also identify and demarcate the property described in Ex.A1 - sale deed dated 20.09.1921 executed in favour of Sellapillai Chettiar, Ex.A2 - Bogium dated 09.06.1947 executed by Sellapillai Chettiar in favour of Maariapillai and Ex.A5 - Settlement deed dated 08.09.2008 executed in favour of the plaintiff correlated to the suit schedule given in the suit in O.S.No.514 of 2009.

For this purpose, the learned Advocate Commissioner shall given the assistance of the Surveyor as and when a request is 1/3

made by him to the Revenue Authorities. The learned Advocate Commissioner shall submit his report before this Court on or before 27.02.2024 and he shall be paid an initial remuneration of Rs.30,000/- (Rupees Thirty Thousand only) excluding the other expenses, on or before 02.02.2024, by the appellant.

Accordingly, this petition in C.M.P.No.22324 of 2023 is ordered. The Registry is directed to send the warrant to the learned Advocate Commissioner forthwith.
