ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences under Sec.4(1)(aaa), 4(1-A) of TNP Act r/w 4(1)(A) Amendment Act 2024 and 14 A of TNP Act in Crime No.228 of 2025 on the file of respondent police, seeks anticipatory bail.

The case of the prosecution is that on 29.07.2025 around 11.00 hours, when the respondent police along with his team went to the place of occurrence, intercepted the petitioner, the petitioners along with other accused said to have tried to transport ID arrack and on search, they found that they were in possession of 1500 bottles, each containing 180 ml of ID arrack liquor, totally 270 litres of ID arrack and seized the same. Hence, the complaint.

3. The learned counsel appearing for petitioners would submit that they are innocent persons and they have not committed any offence as alleged in the 2/5

complaint and based on the confession of A1 and A2, they have been falsely implicated in this case as if they illegally transported 270 litres of ID arrack. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the respondent police seized totally 270 litres OF ID arrack from the petitioners and they are arrayed as A3 to A5. He would submit that A1 and A2 were arrested and no previous case pending against the petitioners. He would submit that if they are granted anticipatory bail, they will abscond and also tamper the witnesses and investigation is not yet completed. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

Considering the above fact and circumstances of the case, and according to prosecution, they were involved in illegally transporting totally 270 litres of ID arrack without any valid license and considering the fact that the investigation is not yet completed and at this stage, if they are released on anticipatory bail, they would abscond and also tamper the witnesses, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
