This petition has been filed to modify the condition (c) imposed by this court in order dated 18.07.2024 in the above Criminal Original Petition.

The learned counsel for petitioner/intervenor would submit that the petitioner is the defacto complainant and he prayed to modify the condition (c) imposed by this court wherein, the wife of 2nd respondent was permitted to withdraw the amount of Rs.7 lakhs, which was ordered to be deposited by the accused. The learned counsel for petitioner/defacto complainant would submit that he is father-in-law of 2nd respondent and he wanted to withdraw the said amount, since because he has given all his retirement benefits around Rs.38 lakhs, so that only the complaint arose. However, there is a matrimonial dispute between son-in-law and his daughter. Hence, he prayed to permit him to withdraw the amount deposited in Crime No.74 of 2024.

3. On considering submissions of defacto complainant, this Court is inclined to modify the condition to that effect and the petitioner/defacto complainant is permitted to withdraw the amount of Rs.7,00,000/- (Rupees seven lakhs only) deposited in Crime No.74 of 2024 on filing undertaking affidavit and on production of proper identification and acknowledgement. Accordingly, this Criminal Miscellaneous Petition is ordered.
