Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents not to grant permission to open a new private liquor retail shop along with bar facility right opposite to the Keelvanjur Village Bus stop, Karaikal, Puducherry and consequently directing the respondent to restrict and regulate the grand of permissions to open new private liquor retail ships along with bar facility according to the population of Keelavanjur Village.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.A.Madhan, learned counsel for the petitioner and Mr.S.Raveekumar, Government Pleader (Puducherry) for the respondents.

2. Learned counsel for the petitioner submits that the respondents be directed not to grant permission to open new private liquor retail shop, along with bar facility, right opposite to the Keelvanjur Village Bus stop, Karaikal, Puducherry.

3. According to the learned Government Pleader (Puducherry), the shop, for which objection is being made, is only being relocated and it is not a permission for a new shop and it is also relocated to a location where there are no restrictions viz., no schools or religious places existing within 50 and 100 meters respectively.

4. Be that as it may, as a representation has been given by the petitioner on 28.06.2023 to the District Collector, the District Collector may take a decision upon the said representation on its own merits and in accordance with the law and policy, preferably within a period of three months.

5. With these directions, the writ petition stands disposed of. There will be no order as to costs.
