ORDER

This Criminal Original Petition has been filed to direct the respondents 1 to 3 not to harass the petitioner in G.3/10981/2308/SP/VPM/2022 dated 20.07.2022 and 21.10.2022 on the file of the District Crime Branch, Villupuram, the third respondent herein.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents. 3.The petitioner was working as a Secondary Grade Teacher in the Government Aided Middle School, Guduvampoondi, Melamalayanur Block, Villupuram District. One Venkatesh Babu had given a complaint against the husband of the petitioner that he had cheated him by receiving Rs.5,00,000/- on the promise to secure him a job.

4. The learned counsel for the petitioner submitted that the petitioner had no connection with the above transaction as alleged by the said Venkatesh Babu and her husband is also no more now; on the complaint given by Venkatesh Babu, the respondent police is harassing the petitioner

by frequently making calls asking her that she should come for enquiry.

5. The learned Government Advocate (Crl.Side) submitted that the earlier complaint given in this regard was already closed and once again, the very same person has given an another complaint.

6. Since the allegations were made only against the husband of the petitioner and the petitioner did not have any involvement in the said offence, it is unnecessary to summon her frequently. In this regard, the petitioner herself has given a representation seeking protection. But the same was not considered by the respondent police. Since the petitioner is a School Teacher and she cannot be held liable for the offence committed by her deceased husband, the police shall not harass the petitioner in the name of enquiry on the complaint given by some third party.

7. The petitioner herself has given due representation in this regard and hence the respondent police shall consider the same and do the needful in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

8. With the above observations, this Criminal Original Petition is disposed.
