Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Respondents 1 to 4 to dispose off the representations made by the Petitioner Company on 20.07.2023 and served on the Respondents on 24.07.2023 in which a request has been raised by the Petitioner Company to make the GST payment dues of Rs.187 lakh towards the Works contract of the Petitioner Company being implemented in R.O.C No.3478/2012/MD3 dated 04.09.2015 within a reasonable time frame as fixed by this Court. ORDER
This writ petition has been filed to direct the respondents to consider the representation dated 20.07.2023 made by the petitioner. 2.By consent of the parties, the main Writ Petition is taken up for disposal at the time of admission stage itself.
3. The learned counsel for the petitioner would submit that the petitioner has made a representation on 20.07.2023, served on 24.07.2023, for the remittance of GST payment for the contract bills. 2/5
However, the said representation was not considered by the respondents till date. Hence, this writ petition has been filed by the petitioner to consider the representation and pass appropriate orders.
4. Mr.P.Balathandayutham, the learned Special Government Pleader, takes notice on behalf of the respondents and requests this Court to pass appropriate orders.
5. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and also perused the materials available on record.
6. In view of the above, this Court directs the respondents to consider the petitioner's representation dated 20.07.2023 on its own merits and dispose of the same in accordance with law within a period of four weeks from the date of receipt of copy of this order.
7. With the above directions, this writ petition is disposed of. No costs.
