PETITION under Article 226 of The Constitution of India praying for issuance of a Writ of Mandamus directing the third respondent herein to consider the petitioner's representation dated 8.11.2016 and release the vehicle bearing Regn.No.TN-37-AR-6688.

Mr.S.Diwakar, learned Special Government Pleader accepts notice for the respondents. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner seeks a direction to the third respondent to consider the petitioner's representation dated 8.11.2016 for the release of the vehicle

(2) T.S.SIVAGNANAM,J RS bearing Regn.No.TN-37-AR-6688.

3. When the said vehicle was transporting rocks from a private patta land, the vehicle has been seized by the third respondent on the allegation that the said vehicle was used for illicit mining.

4. The learned counsel for the petitioner would state that the said vehicle was used only for removal of the rocks from the land of one Mr.Palani so as to enable him to carry on agricultural activities and that there is no illicit mining.

5. In any event, since the representation for release of the vehicle is pending consideration before the third respondent, the writ petition is disposed of with a direction to the third respondent to consider the representation dated 8.11.2016 on merits and in accordance with law and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order. No costs.
