O R D E R
The petitioner, who was arrested and remanded to judicial custody on 05.07.2025, for the offence punishable under Sections 25(1-B)(b) of Arms Act and Sections 4 and 5 of Explosive Substances Act, 1908, in Crime No.100 of 2025, registered on the file of the respondent, seeks bail.
2. The petition for bail is filed stating that the petitioner is an innocent person. It is contended that, in view of the earlier criminal cases (most of them already ended in acquitted or action dropped), the petitioner has been falsely implicated by branding him as a hardcore criminal. It is further submitted that nothing incriminating was seized from the petitioner and that the alleged seizure is a foisted and concocted story. The petitioner is having 2 female kids and being the sole bread winner of the family, his incarceration for more than 52 days had put him and his family in great hardship.
3. The Learned Public Prosecutor for the Union Territory of Puducherry submitted that the petitioner herein was arrested on 05.07.2025 at early hours during the special drive in search of notorious criminals. In the course of personal search, the following items were seized from his possession: 2/6
(i) one iron handled veecharuval (length about 1 3⁄4 feet), (ii) one wooden handled veecharuval (length about 2 feet), (iii) one iron pipe (length about 2 3⁄4 feet), (iv) two iron pipes (length about 2 1⁄2 feet each), and (v) one VIVO android mobile phone.
4. Besides, in a gunny bag in his possession, the following were recovered:
1) a small paper packet containing 200 grams of iron nails,
2) a small bundle of jute thread,
3) a green colour polythene bag containing 250 grams of pebbles stone and
4) a Khaki colour rolled sheet containing 100 grams explosive powder.
5. It is stated that the petitioner has confessed that he had collected the above items for preparing country bomb to threaten entrepreneurs in his area for extortion of money.

6. According to the prosecution, the petitioner is a History-sheeter involved in criminal cases for murder, attempt to murder, NDPS offences and Explosive substances. The bail petition is opposed on the ground that the chemical analysis report on the explosive substance seized from the accused is yet to be received and the investigation about the source of the explosive substances and the proposed target of the crime not yet ascertained. It is further contended that, if the petitioner is released on bail at this juncture, there is possibility of tampering evidence.
7. Heard the submissions made on behalf of the petitioner and the Learned Public Prosecutor appearing for the Union Territory of Puducherry. The CD was called for and perused.
8. The chemical analysis report about the alleged explosive substance seized from the petitioner and its source not yet concluded. Taking note of the fact that dangerous weapons and explosive substances were allegedly recovered from the petitioner and the investigation of the case is at crucial stage, this Court is of the view that the petitioner is not entitled for bail at this juncture. Accordingly, the petition for bail stands dismissed. 4/6
