ORDER

The present criminal original petition has been filed to direct the respondent to register a case on the basis of the petitioner's complaint dated 27.11.2015.

2. The petitioner is residing at No.2, Eranian Street, Solar, Erode along with her husband, namely, Arunavadivel, who is mentally deranged and he is also addict to liquor. The said Arunavadivel is the only legal heir to succeed his family property, which is worth about several lakhs. While so, the petitioner's husband's paternal uncle namely, Palanisamy and other relatives, namely, Devaraj, Ramalingam and Thulasimani are trying to grab the property from her husband illegally, by taking advantage of his condition. Hence, the petitioner lodged a complaint dated 27.11.2015. But, till date, no action has been taken on the said complaint. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the first respondents.

4. The learned Additional Public Prosecutor submitted that the complaint is pending with the Inspector of Police, Erode Taluk Police Station. He further submits that the allegations made in the complaint do not constitute any cognizable offence. Thus, he opposed to give suitable direction. The learned counsel for the petitioner denies the same and sought for suitable direction.

In view of the submissions made on either side, this Court is of the opinion that since the complaint is now pending with the Inspector of Police, Erode Taluk Police Station, he is directed to conduct enquiry on the complaint given by the petitioner and dispose of the same in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
