Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pass orders on the representation submitted by the petitioner dated 12.11.2023 in pursuant to the proceedings issued by the 3rd respondent dated 21.09.2023 for granting stepping up of pay on par with his junior Thiru K.A. Arunagiri in the post of B.T Assistant (Tamil) with all consequential and other attendant benefits including arrears of salary and interest for belated settlement of retirement benefits including the benefit under G.O.Ms.No. 235 Finance(Paycell) Department dated 1.06.2009 with further direction to the respondents by considering the representation submitted by the petitioner dated 12.11.
2023 for payment of interest for belated settlement of regular pension and terminal benefits such as DCRG, Gratuity, Earned leave salary , Unearned leave for personal affairs commutation etc. at the rate of 12 percent per annum within a time frame to be fixed by this Honble Court. This Writ Petition has been filed seeking a direction to the respondents to consider the representation submitted by the petitioner dated 12.11.2023.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The learned Senior Counsel appearing for the petitioner submitted that the petitioner has raised so many grievances in respect of his promotion and submitted a detailed representation to the respondents.
4. On a perusal of the records, it is seen that the representation submitted by the petitioner, after a lapse of nearly two and a half years, cannot be considered.
5. In view of the above, the petitioner is at liberty to submit a fresh representation. On receipt of such representation, the fourth respondent is directed to consider the same and pass appropriate orders on 3/6
merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
6. In the result, this Writ Petition stands dismissed. There shall be no order as to costs.
