ORDER

The present criminal original petition has been filed to direct the second respondent to register the complaint given by the petitioner on 12.12.2015 and investigate the matter in accordance with law.

2. The petitioner is running a brick factory under the name and style of M.N.R. Bricks at No.102, Reddiyur Village, Pappaneri Road. Due to heavy rain, two years back, all the bricks were spoiled and the petitioner has filed a claim petition before this Court and the same is pending. While so, on 12.12.2015, when the petitioner went to his factory, he found that the articles in the room, viz, Soil Car Track, Kadaparai, Manvetti, Blue colour tharpai, Tata Steel Board and 2''2 Angble were found stolen from the room. Hence, the petitioner has https://hcservices.ecourts.gov.in/hcservices/

lodged a complaint against one Murugan @ Murugesan, Kozhi Pannai Tiorupathi, Vellak Kuttar Srinivasan and Srinivasan. But, till date, no action has been taken on the said complaint. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the first respondents.

4. The learned Additional Public Prosecutor submitted that that the allegations made in the complaint do not constitute any cognizable offence. Thus, he opposed to give any direction for registering a case. The learned counsel for the petitioner denies the same and sought for suitable direction.

5. In view of the submissions made on either side, this Court is of the opinion that since the complaint is now pending with the second respondent police, this Court directs the second respondent to conduct enquiry on the complaint given by the petitioner and dispose of the same in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
