The petitioner, who was arrested and remanded to judicial custody on 21.08.2023 for the offences punishable under Sections 4(1)(a) and 4(1-A) of Tamil Nadu Prohibition Act in Crime No.562 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an accused in Crime No.562 of 2023 for the offences under Sections 4(1)(a) and 4(1-A) of Tamil Nadu Prohibition Act. He further submitted that, petitioner is innocent and he is falsely implicated in this case. Petitioner is in judicial custody from 21.08.2023. Thus, he prays for grant of bail.

It is the submission of the learned Additional Public Prosecutor that on the basis of the secret information received, on 21.08.2023, the de-facto complainant along with the police party visited the house of the petitioner and found the petitioner standing near his house with a white colour sack. mpl containing illicit liquor. The illicit liquor and the brandy were seized. He further submitted that the petitioner is having five previous cases registered against her.

4. In response, the learned counsel for the petitioner submitted that one case ended in conviction by paying fine and other cases are pending.

5. Considering the submissions of the learned counsel for the petitioner it is clear that there are still four similar cases pending against the petitioner/accused at various stages and the investigation in this case is not completed. In the said circumstance, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
