PRAYER : This petition has been filed under Section 482 of Cr.P.C, to withdraw and transfer the above mentioned STC No. 66 of 2018 on the file of the Fast Track Court Tiruvallur to Fast Track Court Poonamalle. For petitioner : Mr.C.S.Prabu For respondent: Mr.K.Balasubramaniam

ORDER

The petitioner herein filed this petition to withdraw and transfer the above mentioned STC No. 66 of 2018 on the file of the Fast Track Court Tiruvallur to Fast Track Court Poonamalle.

2. The learned counsel for the petitioner submits that the respondent

herein filed the complaint one in STC No. 534 of 2018 at Poonamallee and another complaint in STC No. 66 of 2018 at Tiruvallur in both the complaints the respondent marked the very same sale agreement. Further, he stated that both the complaints were aroused on the base of same transaction and documents are interlinked. Hence, he prays to transfer the above mentioned STC No. 66 of 2018 on the file of the Fast Track Court Tiruvallur to Fast Track Court Poonamalle.

3. Heard both sides.

4. On perusal of the records, it reveals that the witnesses were examined and the Trial has begun, at the fag end of the Trial the petitioner filed this petition. Thus, I am not inclined to allow this petition. Accordingly, this petition is dismissed. No costs. Consequentially, connected miscellaneous petitions are closed.
