CMP.No.5311 of 2020 in S.A.No.259 of 2013 SATHI KUMAR SUKUMARA KURUP, J., This Civil Miscellaneous Petition has been filed to condone the delay of 2014 days in filing the Petition to set aside the abatement caused due to the death of deceased 1st Respondent namely K.A.Subramanian in this Second Appeal.

2. The learned Counsel for the Appellant submitted that the date of death was intimated belatedly.

3. Even though the learned Counsel for the Respondent filed counter objecting the delay as well as abatement. On being satisfied with the reasons stated in the affidavit filed by the Petitioner, the delay is condoned and this Petition is allowed.
