CMP.No.5306 of 2020 in S.A.No.259 of 2013 SATHI KUMAR SUKUMARA KURUP, J., This Civil Miscellaneous Petition is filed by the Executive Officer, Arulmigu Subramania Swamy Temple, Kumarasamy Pettai, Dharmapuri under Order XXII Rule 9 of CPC seeking to set aside the abatement caused due to the death of deceased 1st Respondent namely K.A.Subramanian in this Appeal.

2. The learned Counsel for the Appellant submitted that the date of death was intimated belatedly.

3. Even though the learned Counsel for the Respondent filed counter objecting the delay as well as abatement. On being satisfied with the reasons stated in the affidavit filed by the Petitioner, this Petition is allowed.
