These two C.M.Ps have been filed to give extension of time till 15.11.2019 to vacate the premises in question, as has been ordered by this Court, by the order dated 29.04.2019.

Heard Mr.Sundara Vadhanan, learned counsel for the petitioner, who would submit that, as assured before this Court, pursuant to the order passed by this Court, in order to comply with the order, to vacate the premises in question on or before 30.09.2019, the petitioner, after taking best efforts, had purchased a flat and he has already fixed the house warming ceremony of the newly purchased flat on 27.10.2019 and immediately he will shift his residence from the petition premises and therefore, he seeks extension of time till 15.11.2019.

Heard Mr.R.Karthikeyan, learned counsel for the respondent, who would submit that, as per the order of the Court, he should have arranged for alternative arrangement to vacate the premises and hand over delivery of possession by 30.09.2019 and if at all he wants some time for the aforesaid reasons, such a long time till 15.11.2019 may not be necessary and therefore, extension of time as sought for by the petitioner cannot be granted.

4. I have considered the submissions of both sides. Taking into account the said submissions made by the learned counsel for the petitioner as he has already fixed the house warming ceremony on 27.10.2019, a reasonable breathing time to vacate the premises atleast for 2 to 3 days can be granted and by 31.10.2019, he can deliver the vacant possesion of the petition premises to the respondent landlord.

In that view of the matter, these petitions are ordered, giving extension of time to the petitioner to vacate the premises on or before 31.10.2019 and it is made clear that within the evening hours of 31.10.2019, at any cost, the vacant possession of the building with key should be handed over to the respondent landlord by the petitioner.
