No appearance COMMON ORDER A.No.5653 of 2024 is filed by the petitioner in O.P.No.6 of 2023 to record her evidence through Video conferencing. Tthe petitioner has also taken out another application in A.No.6171 of 2024 to appoint an Advocate Commissioner to record her oral evidence, stating that due to health condition, she is unable to move around and appear in person before the Court for deposing.
2. Taking note of the fact that the matter relates to the grant of Letters of Administration in respect of estate of late Mrs.Ammalukutty Amma and the petitioner claims to be the daughter of said Mrs.Ammalukutty Amma. The petitioner relies on the legal heirs issued by the Tahsildar, Malapuram District, Kerala in support of the claim. The examination of the witness is necessarily to be done in person to record the demeanor and other aspects.
3. Accordingly, the application for examining the witness through Video conferencing and to appoint an Advocate Commissioner to record oral evidence stands dismissed.
