This writ petition has been filed for the issue of writ of mandamus directing the respondent to consider the representation made by the petitioner on 24.03.2024, wherein the petitioner has sought for 1/5

rectification of pay anomaly and for stepping up the pay of the petitioner on par with his juniors in the light of the proceedings of the respondent dated 10.02.2024.

2.Heard the learned counsel for the petitioner. 3.The case of the petitioner is that he was appointed as Sanitary Worker in the year 1997 after he was sponsored by the Employment Exchange. In the year 2007, the services of the petitioner was regularized. The services of the petitioner was regularly utilized for driving, but however, the pay scale of the Driver was not sanctioned to the petitioner. This happened from 2012 onwards. In the year 2021, the petitioner was promoted as Junior Assistant.

4.The further case of the petitioner is that the Coimbatore Corporation passed orders on 10.02.2024 sanctioning pay scale of the Driver to the petitioner. At that point of time, the petitioner found that his juniors were drawing a higher salary. Therefore, the petitioner made a representation to rectify this anomaly and to step up the pay of the petitioner in line with the juniors. Since, the same was not considered, 2/5

the present writ petition has been filed before this Court. 5.Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the respondent to deal with the representation made by the petitioner on 24.03.2024 on its own merits and in accordance with law and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

6.The petitioner is directed to make a fresh representation to the respondent along with all the relevant documents and also a copy of this order.

7.In the result, this Writ Petition is disposed of with the above directions. No costs.
