The petitioner herein seeks anticipatory bail in Crime No.59 of 2023 registered by the respondent Police for the offence under Sections 294(b), 376(2)(n), 417 and 506(ii) r/w section 34 of IPC.

2. The learned counsel for the petitioner stated that the petitioner has been falsely implicated as an accused in this case. Apprehending arrest from the respondent police, he seeks bail to the petitioner.

The learned Government Advocate (Criminal side) stated that defacto complainant had given a complaint stating that her father had already died and she had qualified B.Tech, B.Ed and working as a teacher in a School and she has come into acquittance with the petitioner herein in August 2017 and they also had sexual relationship. It is also stated that the petitioner had obtained job as Junior Engineer Assistant at ONGC at Karaikal and thereafter the relationship stood frustrated. It is stated that the defacto complainant sought for engagement.

4. In response, learned counsel for the petitioner stated that both the petitioner and the defacto complainant are educated persons and their sexual relationship was consensual. It is seen that father of the present petitioner had been taken into custody and been released on bail, but however, the learned counsel for the respondent stated that the petitioner has been absconding. The statement of the victim girl had been recorded on 03.08.2023 by the learned Judicial Magistrate I, Karaikal and it is clear that she had reiterated the allegations particularly under Section 376(2)(n) and 417 IPC.

5. Taking all these factors into consideration, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
