The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 379 and 430 of I.P.C, in Crime No.428 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal transportation of five bags of river sand in a two wheeler. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner along with other accused have 1/3

illegally transported 5 bags of river sand in a two wheeler. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record.

6. Considering the facts and circumstances and as per directions of the Hon'ble Supreme Court regarding illegal sand mining, smuggling and theft of sand and minerals, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 22.09.2023 ata 2/3
