The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Section 294(b), 324, 302, 506(2) IPC in Crime No.175 of 2023, seeks anticipatory bail. 2.The learned counsel for the petitioner relies on an order dated 19.10.2023 in Crl.O.P.No.24363 of 2023, wherein A1 and A2 had been granted bail. They had been in custody from 06.09.2023 onwards. It is stated that all the accused persons had a land dispute with the defacto complainant and when the wife of the defacto complainant was doing agriculture work, A1 and A2 had hit her by using shovel and pulled her hairs and strangulated her causing death. Further statements had been recorded on 08.09.2023 wherein, it is stated that on the instigation of the present petitioner, who is also the adjacent land owner that the entire incident had happened.

3.This petition seeking anticipatory bail cannot be equated with that of A1 and A2, who had been in custody for more than 30 days. Accordingly, this Criminal Original Petition stands dismissed. 15.11.2023 smv 1/2 https://www.mhc.tn.gov.in/judis
