The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120(b), 294(b), 506(ii), 406, 420 of IPC in Crime No.445 of 2023, seeks anticipatory bail. 2.The petitioner is A3 in Crime No.445 of 2023, originally registered by the Central Crime Branch, Kallakurichi and subsequently, investigation transferred to the District Crime Branch Kallakurichi. 3.The case of the prosecution is that the accused persons had run a chit company under the name of 'Saratha Self Help Group' and as on date, nearly about 25 persons had given a complaint that they had paid a sum of Rs.50,81,000/- and they had been cheated of their amounts. This Court had examined the anticipatory bail petition of A5 and had dismissed the same on 31.10.2023 for the second time. The first time, it had been dismissed on 01.09.2023. However, A5 had not been still secured.

smv 5.However, it is stated that A2 is the uncle of the present petitioner and all of them had gone around collecting money from various customers to a total extent of more than Rs.50,00,000/-. 6.Taking into consideration that there is no recovery of any amount, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 7.The learned counsel for the petitioner states that he wants to withdraw the petition, but however, orders have been passed. 8.List this matter along with Crl.O.P.No.24577 of 2023 under the caption for reporting compliance of taking the respective accused into custody on 01.12.2023.
