JUDGMENT

Today, the matter is listed under the caption " for reporting settlement". 2.When the second appeal is taken up for hearing, the learned counsel for the appellant submitted that the appellant paid the entire rent arrears as demanded by the respondent temple and submitted an application before the

Commissioner, HR & CE Department, Chennai for his recognition as tenant of the suit property under the respondent temple.

3. It is seen from the order passed by the Commissioner, HR & CE Department, Chennai in his proceedings vide Na.Ka.No.2233245/2025/M2 dated 20.04.2026, the Trust Board of the respondent temple passed a resolution to recognise the appellant as tenant of the suit property under the respondent temple and also to compromise the second appeal in SA.No.656 of 2020 subject to the sanction by the Commissioner, HR & CE Department. Based on the said resolution passed by the Trust Board of the respondent temple, the Commissioner, HR & CE Department passed an order in the above mentioned proceedings directing the respondent to submit a proposal for recognising the appellant as a tenant of the respondent temple for a period of five years subject to various conditions mentioned in the order.

4. Since the Commissioner, HR & CE Department already passed an order for recognition of the appellant as tenant of the respondent temple for a period of five years, the learned counsel for the appellant and respondent would submit that no other adjudication is required in this second appeal and the same may be disposed of by recording the order passed by the the Commissioner, HR & CE Department in his proceedings Na.Ka.2233245/2025/M2 dated 20.04.2026.

5. Accordingly, the order passed by the Commissioner, HR & CE Department dated 20.04.2026 is recorded and the second appeal stands disposed of as no further adjudication is required. The order passed by the Commissioner, HR & CE Department dated 20.04.2026 shall form part of this order. Consequently, the connected miscellaneous petition is closed.
