The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 465, 467, 468, 471, 420 and 120(B) of IPC in Crime No.53 of 2025 on the file of the respondent Police, seeks anticipatory bail.
2.The allegation against the petitioner is that the de-facto complainant, namely, Arul lodged a complaint before the respondent police stating that he had purchased 2400 sqft land in Lakshmi Prakash Nagar, Plot No. 42 comprised in Survey Nos.26/7 and 27/4 registered by way of Document No. 5500/1983 and he was in possession. When he wants to sell the same and on verification of encumbrance certificate, it was found that the petitioner joining hands with the other accused persons by impersonating the signature of the de-facto complainant, executed a Power of Attorney Deed on 08.11.2017 vide Document No.10668 of 2017 in favour of A4-Nirmala and subsequently, it was cancelled. Thereafter, the petitioner sold the land 2/6
measuring to an extent of 1200 sqft., to one Rohith, vide Document No.13163 of 2018 and another 1200 sqft to one Anusha vide Document No.13165 of 2018, thereby grabbed the land of the de-facto complainant. Hence the case.
3. The learned counsel for the petitioner submits that already A1 was arrested and released on bail in Crl.M.P.No. 1267 of 2025, dated 16.07.2025 on the file of Judicial Magistrate No.I, Poonamallee. He further submits that the petitioner is falsely implicated in this case based on the confession statement given by the co-accused. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner. 3/6
4.The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that already A1 was arrested and released on bail in Crl.M.P.No. 1267 of 2025, dated 16.07.2025 on the file of Judicial Magistrate No.I, Poonamallee. He furtehr submits the investigation is pending. However, he opposed for grant of anticipatory bail to the petitioner.

Taking into the aforesaid submissions made by the learned counsels on either side; that the gravity of the offence committed by the petitioner; that the petitioner had actively participated in the commission of crime; that the investigation has not yet completed; this Court is not inclined to allow this Criminal Original Petition.
6. Accordingly, this Criminal Original Petition is dismissed. 24.09.2025 4/6
